MEMBERSHIP AGREEMENT

Company: Everhome Pet Guardians LLC, a Delaware limited liability company (“Company”).

Member/Customer: The person completing checkout (“Member”).

Effective Date: Upon successful checkout and acceptance below.

1) What this Membership is

This is a present-day planning membership with a conditional promise: if the Biblical event commonly called the “Rapture” occurs (defined below), Company will use reasonable best efforts to retrieve and care for the pets you enroll, where lawful and safe. This is not insurance and provides no pre-trigger services.

2) Trigger Event (the only trigger)

A “Trigger Event” occurs only upon a widely reported global disappearance commonly referred to by Christian communities as the “Rapture,” verified by Company using at least two independent public news sources.

Explicit Exclusions. The Membership does not activate for any other circumstance, including but not limited to: local/regional/national emergencies; wars; nuclear/EMP events; natural disasters; epidemics/pandemics; power/communications outages; government orders/evacuations; civil unrest; missing-person cases; or any individual hardship. No “welfare checks.” No pre-trigger dispatch.

3) No pre-trigger services

Before a Trigger Event, Company has no duty to collect keys/codes, perform home visits, conduct welfare checks, or hold funds for future care. Member may update enrollment data at any time.

4) Post-trigger efforts (no guarantee)

After Company verifies a Trigger Event, Company will attempt to: (a) retrieve enrolled pets from the address provided by Member; and (b) provide humane care for the remainder of each pet’s natural life, subject to lawful access, safety, and feasibility. Company may delay, modify, or decline retrieval when conditions are unsafe, unlawful, infeasible, or when lawful access cannot be obtained.

5) Access & cooperation

Member authorizes Company to seek lawful access to the premises (e.g., with landlords, property managers, animal control, or other lawful means). Company will not store Member’s keys or access codes pre-trigger.

6) Covered pets

Only pets listed in Exhibit A (Pet Enrollment) are covered. Working animals, venomous species, regulated exotics, or species requiring special licensing may be excluded or require separate written terms at Company’s discretion.

7) Veterinary care

Member consents to routine and emergency veterinary care post-trigger up to reasonable levels determined by Company in its discretion, considering the pet’s condition and welfare. Euthanasia may be authorized when recommended by a licensed veterinarian to prevent suffering.

8) Fees, renewal, cancellation, refunds

• Fees: Member agrees to pay the posted monthly or annual fee (plus taxes, if any).

• Auto-renewal: Renews month-to-month or year-to-year until canceled.

• Cancellation: Member may cancel anytime effective at the end of the current billing period.

• Refunds: Setup fees (if any) are non-refundable. Prepaid periods are refundable pro-rata if Company terminates without cause.

• Multi-pet discounts: Apply to subscription plans only and are quantity-based per billing period.

• Charges: Member authorizes recurring charges to the chosen payment method.

9) Not insurance; no financial guarantees

This Membership is not an insurance policy or financial product. No specific outcome, timing, or success is guaranteed.

10) Liability limit; no indirect damages

To the maximum extent permitted by law, Company’s aggregate liability to Member for any claims relating to this Membership is limited to the fees paid by Member in the 12 months before the event giving rise to the claim. No liability for indirect, incidental, special, consequential, reliance, or punitive damages.

11) Termination

Company may terminate on written notice for: (a) non-payment; (b) misuse or fraud; or (c) changes in law or conditions that make performance impracticable or unlawful. Member may cancel per Section 8.

12) Subcontracting

Company may use subcontractors or partner organizations. Company remains responsible for their performance under this Agreement.

13) Privacy

Company collects minimal information to administer accounts and enrolled pets, as described in the Privacy Notice referenced at checkout.

14) Disputes; governing law

This Agreement is governed by the laws of Delaware, without regard to conflicts rules.

Disputes will be resolved by binding arbitration in Cumberland County, Pennsylvania, on an individual basis (no class actions).

15) Miscellaneous

Entire agreement; severability; assignment (Member may not assign without Company consent); notices by email; updates posted on the site and effective upon Member’s next renewal; headings for convenience only.

By checking “I agree” and completing checkout, Member accepts this Agreement.

Term Plan Addendum (Decade Plan)

For purchases labeled “Decade Plan (10-Year Membership),” the Membership term is ten (10) years from the Effective Date. Fees are one-time and non-recurring. All other provisions of the Membership Agreement apply, including Trigger Event, Exclusions, and Post-Trigger Efforts. The Decade Plan does not auto-renew. Company may refund a pro-rata portion if Company terminates without cause before the end of the term.
